In this episode of the Freedom Update, Christine examines government expropriation. This is when the government takes private property for a public purpose. But sometimes land is expropriated without the government actually taking title to the land. This is called “de facto” expropriation, and the test for this kind of expropriation is being considered by the Supreme Court.

The CCF will be intervening in that case to argue in favour of a new test for de facto expropriation.
