The government is determined to die on this hill

On February 14, 2022, Prime Minister Trudeau’s government invoked the never before used Emergencies Act. Within days, the Canadian Constitution Foundation filed a legal challenge against this unprecedented and dangerous use of the Act.

Though emergency powers were only in force for a short time, the use of this extraordinary piece of legislation in response to the trucker convoy protests was unnecessary and damaging to both Canada’s democracy and our shared rights and liberties as Canadians.

They were never meant for this. And the Federal Court agreed.

On January 23, 2024, Justice Mosley of the Federal Court of Canada, agreed with the CCF and ruled that Cabinet’s invocation of the Act was not reasonable and not justified under section 1 of the Charter.

Now our lawyers are preparing for the appeal process.

We expect the next hearing date to be scheduled for late 2024 or early 2025. The government is determined to die on this hill and fight against Justice Mosley’s initial ruling.
