The Canadian Constitution Foundation filed a petition on November 5, 2024 challenging the City of Whitehorse’s Civility Policy. This policy places unacceptable limits on the freedom of expression of citizens who wish to participate in or observe council meetings, including by regulating their attire.
This policy includes a number of strange restrictions on expression that are simply not justifiable in a free and democratic society. This includes restrictions on “microaggressions” and rules on “vulgar” and ‘inappropriate” attire.
Whitehorse’s City Council did not respond to our letter warning them of the obvious problems with their policy so we have no choice but to seek judicial review. Canadians perhaps interact with local government regulations the most in their daily lives, so it’s very important that these regulations also adhere to our country’s constitution.
We currently await a court date.
